Unlawful Presence

If you are in the United States without a valid visa or green card, the clock is ticking. Normally, if your unlawful presence is less than one year, you will be deported and barred for re-entering the U.S. for three years. If you have been here illegally for more than one year, you may not be able to re-enter the U.S. for 10 years.

With the waiver, you will be able to leave the country and get back in. A waiver of the 3-year or 10-year bar requires extensive documentation of an extreme hardship that your U.S. citizen spouse will suffer if you leave.
